Amendment to Aviation Law: Refunds for Passengers and Benefits for Airlines

An amendment to the Aviation Services Law will protect passengers' rights while encouraging airlines to operate in the Israeli market during challenging times. Israeli airlines will receive government-backed support.

A significant amendment to the Aviation Services Law was approved today (Wednesday) by the Knesset’s Economic Affairs Committee. The purpose of the amendment is to safeguard passenger rights amid the disruptions caused by Operation “Swords of Iron,” while also easing the challenges faced by airlines dealing with prolonged uncertainty due to Israel’s security situation and the ongoing war.

The volatile security environment has led to widespread flight cancellations and delays, causing confusion and frustration for both passengers and airlines. The amendment aims to strike a balance: on the one hand, it provides relief to airlines and encourages them to continue operating in Israel; on the other, it ensures the protection of passengers’ basic rights, such as full refunds for canceled flights.

Key Changes to the Law (Effective for Six Months)

Full Refunds for Canceled Flights: Airlines will be required to issue full refunds for flights canceled between October 8, 2023, and November 30, 2024. The refunds will cover ticket costs only, without additional compensation.

Shortened Notice Period: The amendment reduces the required notice period for flight changes from 14 days (as stated in the original law) to just three days for passengers who planned to travel between December 2023 and February 2024.

Flexibility in Benefits: The Minister of Transport will have the authority to modify passenger benefits in consultation with the Minister of Economy and with the approval of the Economic Affairs Committee. This provision allows for greater flexibility in responding to special circumstances, such as extended security, civil, or health emergencies lasting over two weeks.

Government-Backed Support for Israeli Airlines

To encourage activity in the Israeli aviation market, Israeli airlines will receive government-backed security measures. These include assistance in adding two additional weekly flights to North America, specifically to promote routes between Israel and the United States. The government will cover up to 50% of compensation costs incurred by airlines due to cancellations or operational challenges.

The amendment also addresses the issue of alternative flights, which has been a significant concern over the past year. Airlines canceling flights to or from Israel will now be required to provide alternative travel options through major airports such as Larnaca, Athens, or Dubai.

A Balanced Approach

Minister of Transport Miri Regev emphasized the importance of the amendment, stating: “This amendment seeks to strike a balance between our commitment to maintaining adequate services for passengers and the need to reduce uncertainty for airlines. It is designed to encourage airlines to resume flights to Israel and operate new routes to the United States.”

The revised law aims to stabilize the aviation industry in Israel, ensuring both passenger satisfaction and operational viability for airlines during this challenging period.
